ChordVoyage Terms of Service

1. Introduction
Welcome to ChordVoyage, an iOS application designed to help musicians improve their ear training by identifying chords and chord progressions in various musical modes ("App"). These Terms of Service ("Terms") govern your use of the App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
2. Definitions
- App: Refers to ChordVoyage, the iOS application developed by us.
- User or You: Refers to any individual who downloads or uses the App.
- We, Us, or Our: Refers to the developer of ChordVoyage, based in New York, United States.

3. Eligibility and Account Registration

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on an iOS device you own or control, subject to these Terms. You may not:

The App, including its design, code, content, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the App without our prior written consent.
8. Privacy
We do not collect personal information from users, except for possible crash analytics data to improve the App's performance. User settings (e.g., custom training preferences) are stored locally on your device and will be lost if the App is deleted or your device becomes inoperable.
9. Termination
We may suspend or terminate your access to the App if you violate these Terms or for any other reason, at our discretion. Upon termination, your license to use the App will cease, and you must stop using the App. User settings stored locally on your device will remain until the App is deleted.
10. Limitation of Liability
To the fullest extent permitted by law, we provide the App "as-is" without warranties of any kind, express or implied. We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App, including but not limited to data loss, device issues, or inability to use the App. Your sole remedy is to stop using the App.

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the App or violation of these Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in New York, NY, in accordance with the rules of the American Arbitration Association, except where prohibited by law.
13. Changes to Terms
We may update these Terms at any time. If we make significant changes, we will notify you via the App or our website (chordvoyage.com). Your continued use of the App after such changes constitutes your acceptance of the updated Terms.
14. Third-Party Services
The App may use crash reporting services to improve performance, as described in our Privacy Policy. No other third-party services are integrated. Any third-party services used are subject to their respective terms.
15. Apple-Specific Terms
The following terms are required by Apple:
- These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable) per its refund policy.
- Apple is a third-party beneficiary of these Terms and may enforce them against you with respect to the App.
